1. ELIGIBILITY The Soko Glam x Pucker Giveaway (“GIVEAWAY”) is open only to legal residents of the United States who are 18 years or older or have reached the age of majority in his/her state of legal residence, whichever is older, at the time of entry. The Giveaway is subject to all applicable federal, state and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Administrator’s decisions, which are final and binding in all matters related to the Giveaway. Winning the prize is contingent upon fulfilling all requirements set forth herein. Void where prohibited.
2. HOW TO ENTER To enter the Giveaway during the Entry Period go to sokoglam.com/pages/giveaway to complete the form by providing email address and submit as directed to receive one (1) entry. By entering, entrant agrees to be placed on Soko Glam and Pucker's email list for marketing communications. Each person may enter the Giveaway only one time during the Entry Period. Multiple entrants are not permitted to share the same email address.
3. ENTRY PERIOD The Giveaway begins on February 3, 2016 at 12:01 a.m. EST and ends on February 9, 2016 at 11:59 p.m. EST (the “Entry Period”). Soko Glam is the official time keeper for purposes of the Giveaway.
4. GRAND PRIZE DRAWING On or about February 10, 2016, Soko Glam will randomly select the potential Grand Prize winner from all eligible entries received during the Entry Period. The potential winner will be notified by email. The potential winner may be required to show proof of being the authorized account holder. Receiving a prize is contingent upon compliance with these Official Rules. If the potential winner cannot be contacted, potential winner forfeits the prize. In the event that the potential winner is disqualified for any reason, Soko Glam may award the Grand Prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.
5. ODDS OF WINNING Odds of winning a prize depend on the total number of eligible entries received during the Entry Period.
6. GRAND PRIZE One Grand prize will be awarded which consists of a Pucker VIP Treatment valued at $135 and a Soko Glam Gift Card valued at $100. Winner will have six (6) months from the date of winner selection to redeem his/her prize. No prize substitution except as may be authorized by Pucker or Soko Glam in their sole discretion. Prizes are not transferable, assignable or redeemable for cash. Prizes cannot be used on prior purchases. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Gift cards have no cash value and are subject to their respective terms and limitations.
7. GENERAL TERMS & CONDITIONS Soko Glam reserves the right to disqualify any entrant acting in violation of the Official Rules or found tampering with the entry process or with the operation of the Giveaway. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.
8. ENTRY CONDITIONS AND RELEASE By participating, each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Soko Glam which are binding and final in all matters relating to this Giveaway; (b) release and hold harmless Pucker and Soko Glam, and their respective parents, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Giveaway, and all of their respective past and present officers, members, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Giveaway, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorney’s fees) arising out of or relating to an entrant’s participation in the Giveaway and/or entrant’s acceptance, use or misuse of prize.
9. LIMITATIONS OF LIABILITY The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Giveaway; (d) technical or human error which may occur in the administration of the
Giveaway or the processing of entries; (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize; or (f) any lost, late, misdirected or postage due entries If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Giveaway, provided that if it is not possible to award another entry due to discontinuance of the Giveaway, or any part of it, for any reason, Soko Glam, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Soko Glam reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims.
10. PUBLICITY Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to Sponsors and Administrators and their respective agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for Sweepstakes purposes in any media, worldwide, without further payment or consideration.
11. DISPUTES Except where prohibited by law, as a condition of participating in this Giveaway, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Giveaway, including but not limited to prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the Entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Giveaway), and entrant further waives all rights to have damages multiplied or increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Pucker in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
12. ENTRANT’S PERSONAL INFORMATION:Information collected on-line from entrants is subject to Pucker's and Soko Glam’s respective Privacy Policies which can be found at: http://sokoglam.com/pages/policies. Entrants understand that he/she is providing his/her information to Pucker and Soko Glam.
13. SEVERABILITY If any provision of these Official Rules shall be held invalid or unenforceable, such provision shall be deemed deleted from these Official Rules and replaced by a valid and enforceable provision which so far as possible achieves the parties’ intent in agreeing to the original provision. The remaining provisions of these Official Rules shal l continue in full force and effect.
